Terms & Conditions of Hire
1.1 The “Client” means the person/s, organisation or company booking the equipment, act or entertainment with the “Company”.
1.2 The “Company” means Tom Foolery Photo Booth
2.1 All equipment (including supplied props) remains the property of the company at all times.
2.2 By placing an order with us either verbally, online or via e-mail regardless of whether a Booking Form has been returned, or deposit paid, it is deemed that the customer has read, understood, fully agreed to and is bound by all of our terms and conditions of hire.
2.3 In the event of traffic or other uncontrollable circumstances preventing us from being able to fulfill our contracted obligations our liability shall be limited to a refund of any monies paid in relation to the contracted event, or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid irrespective of any loss of earnings.
Prices, Deposit & Balance Payments
3.1 All hires are subject to a £75 holding deposit, in order to secure the services of the company. Promotional offers require full payment at time of booking.
3.2 The client must pay the deposit at the time of booking in order to fully secure the requested date(s), or within 7 days from the date the booking is made, at our discretion.
3.3 Deposits are non-refundable.
3.4 The balance is to be paid in full and cleared at least 21 days prior to the event start date.
3.5 Advertised prices are subject to change without prior notification, and any future promotional offers will not apply to this booking. However, the price agreed at the time of booking will remain in force.
3.6 The company reserves the right to charge interest on all overdue accounts at 2% above its banker’s current interest rate. Interest will accrue on a daily basis for late payments, starting from the due date. An administration fee of £25 will apply to any late payments.
3.7 An idle fee may apply for waiting periods of above 45 minutes – this will be pre-authorised with the client and invoiced accordingly. We’ll avoid charging for idle hours wherever possible.
3.8 For bookings on Christmas Eve, Boxing Day, New Years Eve, New Years Day, Good Friday or Easter Sunday, all fees will be charged at 1.5 x the standard rate.
4.1 Any cancelled order is subject to the following cancellation charges:
Within 14 days of hire date: No Refund
Within 30 days of hire date: 75% of full hire fee is due
Within 60 days of hire date: 50% of full hire fee is due
Outside of 60 days: deposit forfeited only, less any charges incurred.
5.1 The Client acknowledges that it shall be responsible for any damage or loss to Tom Foolery Photo Booth’s equipment (including props) caused by any misuse of our equipment by its customers or its guests or any theft or disaster (including, but not limited, to fire or flooding) at the client’s event.
5.2 Tom Foolery Photo Booth will require a workspace of at least 3m (W) x 2m (D) x 2.5m (H). To enable us to put all of our props out for use, generally a 3m x 3m space is ideal. The client will be responsible for providing suitable space as well as providing a standard working 13 amp electrical plug socket for power to the hired booth. We also require a table to be provided for your guest book, if ordered.
5.3 All goods remain the property of the company at all times. The props are for use in the booth only and not to be taken away from the booth area.
Site Location, Facilities & Conduct
6.1 Hired equipment will be set up in one location only as agreed on arrival and will not be moved once unloaded.
6.2 If accèss to the venue is delayed for any reason, or events over-run delaying the start of your hire period, no refund shall be given, nor shall the hire period be extended beyond the original finish time without explicit agreement from us.
6.3 The client is responsible for ensuring that the venue has sufficient space available for the booth, and the venue management have been notified. Our insurance certificates are freely available for download.
6.4 The company reserves the right to cease operation and remove hired equipment from site if at any time a representative of the company feels that guests or clients conduct endangers the safety of the guests, clients, themselves or the safety of the hired equipment. In such cases no refund will be given and full contracted fees will be due to the company.
6.5 The company reserves the right to refuse entry to the booth of any guest(s) behaving inappropriately. We want you all to have fun, but your safety and the prevention of damage to our equipment always takes precedence. We will not tolerate any form of abuse directed towards our staff.
6.6 Due to the position of the camera, the booth is unsuitable for unsupervised use by small children. We welcome children into our booth, but may insist they are accompanied by an adult.
Liability & Insurance
7.1 The company’s liability insurance covers use of the equipment only whilst booked on ‘wet’ hire (supervised by a representative of the company).
7.2 The client agrees to indemnify the company for any damage or theft of the company’s equipment whilst on hire.
7.3 The company accepts no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.
Use of Images
8.1 The client gives Tom Foolery Photo Booth permission to use images taken at their event to be used on Tom Foolery Photo Booth’s website, social media pages and for advertising and promotional purposes. Images are usually uploaded to our business Facebook page directly after your event, and onto our website within 5 working days.
8.2 Tom Foolery Photo Booth will not use any images that are deemed unsuitable on their website or for advertising purpose and will not use any content that maybe personally damaging to the person(s).
8.3 Retention of Images: We’ll keep a digital copy of your photgraphs for 1 year after your event, at which point they’ll be deleted permanently.
Hiring, delivery and service
9.1 Delivery set up and removal of the equipment is included in the total amount paid for the hire period.
9.2 Time taken to deliver, set up and remove the equipment will be outside the hire period.
9.3 A fully trained representative of the company will be on site throughout the hire of the equipment.
9.4 Marryoke: We require a minimum of four entire recordings of the same track to enable us to create a mash-up video. If we do not reach the required number of recordings, we still supply any video footage recorded. We need to be situated away from any loud music or this will severely impact on our ability to offer this service.
9.5 Green Screen: this requires automatic replacement of green colours. We cannot be held responsible if persons are wearing green when using the booth. If you have specific images that you require, we need to be advised no later than 1 week prior to your event.
9.6 Guest Books: We will endeavour to maintain your guest book in the condition it was supplied in. We cannot be held responsible for damage caused to the guest book by your guests (e.g. spilling drinks, tearing pages allowing unsupervised children to scribble in them).
9.7 Photo Templates: We need to know your layout requirements, including any specific colours, text, logos or fonts no later than 1 week prior to your event. A proof will be supplied via email for you to check and make sure details are correct.
9.8 Hashtag Printer: This is subject to us being able to obtain either a stable wifi connection provided by your venue, or our own 4G signal being strong enough to maintain a constant connection. To be able to print a photo, the user’s Instagram and/or Twitter account must be public, and they must use the hashtag we specify on the day of your event. We cannot be held responsible for inappropriate images taken by your guests.
9.9 LightningShare: This is subject to us being able to obtain a stable connection via our own 4G mobile router. Note that venue wifi is generally unsuitable for this service
